2 February 2025 — Article 4 enters into force

Member States must adopt national laws for supervision and enforcement.
December 2027 — Enforcement window opens (deferred)
Originally scheduled for 2 August 2026, the enforcement timeline was deferred to December 2027 by the EU Digital Omnibus. The Article 4 duty itself has applied since February 2025 — the deferral moves the penalties, not the obligation. What Article 4 Requires
Who is covered?
All providers and deployers of AI systems. This includes any company that develops, distributes, or uses AI systems — which in 2026 means practically every organization.
What must you do?
Ensure a "sufficient level of AI literacy" for all staff and external service providers involved in planning, implementing, or using AI systems. Training must account for technical knowledge, experience, and context of use.
How is compliance measured?
There is no one-size-fits-all standard. The AI Office does not impose mandatory specific training programs. But you need to demonstrate that training was provided, personalized to roles, and documented.
What are the penalties?
Non-compliance falls under the general infringement tier: up toEUR 7.5 million or 1.5% of global annual turnover, whichever is higher. For SMEs, the lower amount applies.
